First, Clause 1, Article 27 of the Law on Handling of Administrative Violations 2012 stipulates specific provisions on deportation as follows:
Expulsion
1. Expulsion is a form of punishment that forces foreigners who commit administrative violations in Vietnam to leave the territory of the Socialist Republic of Vietnam.
2. The Government shall detail the application of the penalty of expulsion.
At the same time, Article 5 of Decree 142/2021/ND-CP stipulates the subjects to which the penalty of expulsion is specifically applied as follows:
Subjects subject to the penalty of expulsion export
Foreign individuals who commit administrative violations within the territory, contiguous zone, exclusive economic zone and continental shelf of the Socialist Republic of Vietnam; on Vietnamese-flagged aircraft or ships flying the Vietnamese flag, depending on the severity of the violation, will be subject to expulsion as prescribed in Article 27 of the Law on Handling of Administrative Violations.
Thus, from the above regulations, foreigners will be subject to the penalty of deportation when committing administrative violations within the territory of the Socialist Republic of Vietnam.
