Violation of regulations on registration and residence management in Vietnam

Level of administrative fine regulations on registration and residence management in Decree 144/2021/ND-CP in Article 9 as follows:

1. Fine from 500,000 VND to 1,000,000 VND for one of the following acts:

a) Failure to comply with regulations on permanent residence registration, temporary residence registration, deletion of permanent residence registration, deletion of temporary residence registration, separation of households or adjustment of residence information in the Residence Database;

b) Failure to comply with regulations on notification of stay and declaration of temporary absence;

c) Failure to present household registration book, temporary residence book, confirmation of residence information, or other documents related to residence as requested by competent authorities.

2. Fine from 1,000,000 VND to 2,000,000 VND for one of the following acts:

a) Erasing, modifying or committing other acts that falsify the contents of household registration books, temporary residence books, confirmation of residence information, and other documents related to residence;

b) Buying, selling, renting, leasing household registration books, temporary residence books, confirmation of residence information, and other documents related to residence to commit acts contrary to the provisions of law;

c) Borrowing, lending or using household registration books, temporary residence books, confirmation of residence information, and other documents related to residence to commit acts contrary to the provisions of law;

d) Have resided in a new legal residence and are eligible for residence registration but have not completed the procedures to change the place of residence registration according to the provisions of law;

d) Accommodation business, collective housing, medical treatment facilities, tourist accommodation establishments and other establishments with accommodation functions that do not notify the stay of 01 to 03 residents;

e) Organizing to incite, incite, entice, lure, broker or force others to violate the law on residence;

g) Pledge or pledge household registration books, temporary residence books, papers and documents on residence;

h) Destroying household registration books, temporary residence books, papers and documents on residence.

3. Fine from 2,000,000 VND to 4,000,000 VND for one of the following acts:

a) Allowing others to register residence in your residence for personal gain;

b) Accommodation business, collective housing, medical treatment facilities, tourist accommodation establishments and other establishments with accommodation functions that do not notify the stay of 04 to 08 residents;

c) Obstructing citizens from exercising their right to freedom of residence;

d) Giving, brokering, or accepting bribes in residence registration and management.

4. Fine from 4,000,000 VND to 6,000,000 VND for one of the following acts:

a) Providing false information, papers or documents about residence to obtain permanent residence registration, temporary residence registration, declaration of residence information, issuance of other residence-related documents or conduct Other illegal acts;

b) Forging or using fake papers, documents, or data on residence to obtain permanent residence registration, temporary residence registration, declaration of residence information, issuance of other documents related to residence or practice. commit other illegal acts;

c) Forging or using fake household registration books or fake temporary residence books to register permanent or temporary residence, issue other documents related to residence or commit other illegal acts;

d) Accommodation businesses, collective housing, medical treatment facilities, tourist accommodation establishments and other establishments with accommodation functions do not notify the stay of 09 or more residents;

d) Failure to declare temporary residence for foreigners according to the provisions of law;

e) Obstructing or failing to comply with permanent residence inspection, temporary residence inspection, or residence inspection at the request of competent authorities.

5. Additional sanctions:

Confiscate material evidence and means of administrative violations for violations specified in Points a and h, Clause 2, Points b and c, Clause 4 of this Article.
