- Adoptive parents must meet the following conditions:
+) Fulfill the conditions as stipulated by the laws of the country where the adoptive parents usually reside.
+) Meet the conditions as stipulated in Article 14 of the Adoption Law, including:
i) Have full capacity for civil conduct;
ii) Have good moral character;
iii) Not fall into any of the following cases that are not allowed to adopt:
+) Currently having some parental rights restricted for minors;
+) Currently enforcing administrative handling decisions at educational institutions, healthcare facilities;
+) Currently serving a prison sentence;
+) Not having their criminal record expunged for offenses that violate the life, health, dignity, honor of others; abuse or mistreat grandparents, parents, spouses, children, grandchildren, caregivers; coerce or harbor minors to violate the law, trade, swap, kidnap children.
According to Article 14, Clause 3 of the Adoption Law, this procedure does not apply to conditions: adoptive parents older than 20 years and meet the health, financial, living conditions to ensure care, upbringing, education of adopted children.
- Person being adopted as a child must meet the following conditions:
+) Under 18 years old;
+) A person can only be the child of a single person or of both spouses.
