This article explains the concept of urban development program and clarifies the subjects that are eligible for urban development program according to current legal regulations. Understanding urban development program helps you grasp how to organize and implement urban projects effectively and sustainably. The article also provides information on criteria and legal regulations related to urban development program preparation.
Pursuant to Decree 35/2023/ND-CP amending and supplementing Decrees on state management of the Ministry of Construction issued by the Government on June 20, 2023.
In Clause 3, Article 4 of Decree 35/2023/ND-CP, the content of the Urban Development Program in Article 3a was added after Article 3 of Decree 11/2013/ND-CP. Accordingly, the concept of "Urban Development Program" is defined in Clause 1, Article 3a of Decree 11/2013/ND-CP as follows:
“1. The urban development program is a collection of tasks, solutions, programs, projects to implement urban development goals of each stage according to provincial planning and general urban planning, established for the following subjects:
a) Provinces and centrally run cities;
b) City, town of province or centrally run city; town of district;
c) Area planned to form new urban area".
Thus, it can be understood that the urban development program is a collection of tasks, solutions, programs, projects, and plans established for certain subjects with the purpose of implementing the urban development goals of each stage according to the plan.
Accordingly, the Urban Development Program must meet the requirements under Clause 2, Article 3a of Decree 11/2013/ND-CP as follows:
- In accordance with national planning, regional planning, provincial planning, general urban planning; approved strategies, programs, and plans on higher-level urban development; medium-term public investment programs and plans and the ability to mobilize actual local resources;
- Synchronize with technical and specialized planning, orientations, strategies, programs and plans of other sectors and fields related to urban development.
The urban development program must be reviewed, adjusted or newly established based on the results of the review, synthesis and assessment of implementation after each 5-year period or after the competent authority issues new urban development goals or approves plans, strategies, programs and schemes.
Pursuant to the provisions of Clause 1, Article 3a of Decree 11/2013/ND-CP supplemented by Clause 3, Article 4 of Decree 35/2023/ND-CP as follows:
Urban Development Program
1. The urban development program is a collection of tasks, solutions, programs, projects to implement urban development goals of each stage according to provincial planning and general urban planning, established for the following subjects:
a) Provinces and centrally run cities;
b) City, town of province or centrally run city; town of district;
c) Area planned to form new urban area.
Thus, the subjects of urban development programs include:
- Provinces and centrally run cities;
- City, town of province or centrally run city; town of district;
- Area planned to form new urban area.
