This article provides detailed information about the types of works that are protected by copyright. Understanding what is protected helps you ensure your legal rights and protect your creativity from unnecessary infringement.
1. Types of works protected by copyright stipulated in Article 14 of the Law on Intellectual Property 2005 (amended and supplemented 2009, 2019), specifically as follows:
(1) Protected literary, artistic and scientific works include:
- Literary and scientific works, textbooks, teaching materials and other works expressed in the form of writing or other characters;
- Lectures, speeches and other talks;
- Journalistic works;
- Musical works;
- Dramatic works;
- Cinematographic works and works created by similar methods (hereinafter collectively referred to as cinematographic works);
- Fine arts and applied arts
(The amended Intellectual Property Law 2023, effective from January 1, 2023, will amend "Works of visual arts and applied arts" to "Works of fine arts and applied arts")
- Photographic works;
- Architectural works;
- Diagrams, plans, maps, drawings related to topography, architecture, scientific works;
- Works of literature and folk art;
- Computer programs, data collection.
(2) Derivative works shall only be protected as provided in section (1) if they do not prejudice the copyright in the work used to make the derivative work.
The protected works specified in sections (1) and (2) must be directly created by the author through his/her own intellectual labor without copying from the work of others.
2. Objects not covered by copyright protection
- Purely news reporting.
- Legal documents, administrative documents, other documents in the judicial field and official translations of such documents.
- Process, system, method of operation, concept, principle, data.
