Regulations on requests to terminate the validity of title (due to the title owner's declaration of relinquishment of industrial property rights)

The protection title is invalidated when the owner of the title declares to give up industrial property rights. The National Office of Intellectual Property will consider and issue a decision to terminate the validity of the copyright from the date of receipt of the declaration from the owner of the copyright.

1. Dossier to request termination of validity of protection title includes:

+ Declaration requesting termination of validity of protection title (according to form No. 08 in Appendix II of Decree 65/2023/ND-CP) (Form attached).

+ Document explaining the reason for requesting termination of the validity of the protection title;

+ Power of attorney (in case the request is submitted through a representative);

+ Copy of proof of payment of fees and charges according to regulations;

+ Other documents (if necessary).

- Evaluation time limit: 15 days from the date of application submission

- Implementation results: Issue a Decision to terminate the validity of the Protection Title and publish it in the Industrial Property Official Gazette or Notice of refusal to terminate the validity of the Protection Title.

2. Fees and charges:

+ Fee for requesting termination of protection title validity: 50,000 VND/application

+ Fee for appraisal of request to terminate validity of title: 180,000 VND/protection title

+ Fee for announcing the Decision to terminate the validity of the Protection Title: 120,000 VND/application

+ Registration fee for Decision to terminate the validity of the Protection Title: 120,000 VND/Battery Title
