Procedures for granting temporary residence cards to foreigners in Vietnam

1. What is a temporary residence card?

TTemporary residence card is a type of document issued by the immigration management agency or a competent agency of the Ministry of Foreign Affairs to foreigners who are allowed to reside for a period of time in Vietnam and is valid in lieu of a visa. According to the provisions of Clauses 1 and 2, Article 37 of Law No. 47/2014/QH13, the application for temporary residence card includes: written request for temporary residence card with photo, passport, documents proving that the case falls under regulations. in Article 36 of this Law. Agencies, organizations, and individuals inviting or sponsoring directly submit applications for temporary residence cards to foreigners at the immigration management agency where the inviting or sponsoring agency or organization directly submits the documents. Request a temporary residence card for foreigners at the immigration management agency where the inviting or sponsoring agency or organization is headquartered or where the inviting or sponsoring individual resides; Within 05 working days from the date of receiving complete documents, the immigration management agency will consider issuing a temporary residence card.

2. Procedures for granting temporary residence cards to foreigners

Procedures for granting temporary residence cards to foreigners in Vietnam are specified in Article 37, Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014 (amended 2019) as follows:

- Dossier to request a temporary residence card includes:

+ Written request from the agency, organization or individual carrying out invitation and guarantee procedures;

+ Application form for temporary residence card with photo;

+ Passport;

+ Documents proving that the case is specified in Clause 1, Article 36, Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014.

- Processing temporary residence card issuance is as follows:

+ Foreign diplomatic missions, consulates or other authorized agencies in Vietnam submit dossiers to request a temporary residence card with the symbol NG3 at the competent agency of the Ministry of Foreign Affairs;

+ Agencies, organizations, and individuals inviting or sponsoring directly submit applications for temporary residence cards to foreigners falling into the cases specified in Point b, Clause 1, Article 36, Law on Entry and Exit, Transit and residence of foreigners in Vietnam 2014 at the immigration management agency where the inviting or sponsoring agency or organization is headquartered or where the inviting or sponsoring individual resides;

+ Within 05 working days from the date of receiving complete documents, the immigration management agency or competent agency of the Ministry of Foreign Affairs will consider issuing a temporary residence card.
