In Vietnam, technology transfer is regulated by laws to promote economic development and protect national interests. This article provides detailed information on the types of technology that are allowed to be transferred, from manufacturing technology, information technology to biotechnology. Understanding these types of technology helps businesses and investors seize opportunities and comply with legal regulations.

Article 4 of the Law on Technology Transfer 2017 stipulates the subjects of technology to be transferred as follows:

“1. The transferred technology is one or more of the following subjects:

a) Technical know-how, technological know-how;

b) Technological plans and processes; solutions, parameters, drawings, technical diagrams; formulas, computer software, data information;

c) Solutions to rationalize production and innovate technology;

d) Machinery and equipment accompanying one of the objects specified in points a, b and c of this clause.

2. In case the technology subject specified in Clause 1 of this Article is protected by intellectual property rights, the transfer of intellectual property rights shall be carried out in accordance with the provisions of the law on intellectual property.

Thus, based on the above provisions, the transferred technology is: Technical know-how, technological know-how; technological plans and processes; solutions, parameters, drawings, technical diagrams; formulas, computer software, data information; solutions to rationalize production, technological innovation.
