This article provides information on the value of a civil case involving consumer protection that must be achieved to be resolved under the simplified procedure. The simplified procedure helps cases with small values to be processed quickly, saving time and costs for the parties involved. Understanding this condition helps consumers and businesses better prepare when facing legal disputes.
Pursuant to Article 70 of the Law on Consumer Protection 2023, civil cases on consumer rights protection are regulated as follows:
“Article 70. Civil cases on consumer rights protection
1. A civil case on consumer rights protection is a case in which the plaintiff is a consumer or a social organization participating in consumer rights protection as prescribed in this Law. The court shall resolve a civil case on consumer rights protection according to the procedures prescribed in the Civil Procedure Code.
2. Civil cases on consumer rights protection with a transaction value of less than 100 million VND shall be resolved under simplified procedures without having to satisfy the conditions specified in Clause 1, Article 317 of the Civil Procedure Code.
3. Civil cases on consumer rights protection that do not fall under the provisions of Clause 2 of this Article shall be resolved under the simplified procedure when meeting all the conditions specified in Clause 1, Article 317 of the Civil Procedure Code.”
Thus, civil cases on consumer rights protection with a transaction value of less than 100 million VND will be resolved under the simplified procedure without having to satisfy the conditions specified in Clause 1, Article 317 of the 2015 Civil Procedure Code.
