This article provides a detailed look at how the State exercises its rights as the owner of land. Through this study, you will better understand the role and responsibility of the State in land management and use, thereby having a more comprehensive view of current land policies.
The State exercises the right to represent land ownership in accordance with the provisions of Article 14 of the 2024 Land Law and other relevant laws through the following agencies:
- The National Assembly and the National Assembly Standing Committee promulgate laws, ordinances and resolutions on land; decide on national land use planning; exercise the right to supervise land management and use nationwide;
- People's Councils at all levels exercise the right to approve land use planning of their localities before submitting it to competent authorities for approval;
+ Through land recovery to implement socio-economic development projects for national and local public interests according to authority;
+ Approving the change of land use purpose for rice cultivation, special-use forest land, protective forest land, and production forest land according to the authority prescribed by the 2024 Land Law;
+ Decision on land price list;
+ Monitor the implementation of land laws at the local level;
- The Government and People's Committees at all levels shall exercise the right to represent land owners according to the authority prescribed by this Law and other relevant laws.
Note:
Land Law 2024 (effective from August 1, 2024), except for the following cases:
- Article 190 of the 2024 Land Law and Article 248 of the 2024 Land Law take effect from April 1, 2024.
- The establishment and approval of land use planning will continue to be implemented in accordance with the provisions of Resolution 61/2022/QH15 on continuing to increase and enhance the effectiveness and efficiency of implementing policies and laws on planning and a number of solutions to remove difficulties and obstacles, speed up the establishment progress and improve the quality of planning for the 2021 - 2030 period.
- Clause 9, Article 60 of the 2024 Land Law takes effect from the date Resolution 61/2022/QH15 expires.
