According to section 2.1.1 of subsection 2.1 Section 2 National technical standards on occupational safety when working in confined spaces by the Minister of Labor - Invalids and Social Affairs issued with Circular 29/2018/TT-BLĐTBXH regulating the responsibilities of employers as follows:
"2.1.1. Responsibilities of the employer.
- Appointing the licensor, delegating the licensor, suspending work when not following regulations regarding licenses for work related to confined spaces or not ensuring occupational safety and hygiene.
- Assigning individuals to measure, test gas in confined spaces at risk of oxygen deficiency, toxic gases, explosive gases.
- Establishing competency and minimum standards for positions: personnel entering confined spaces, guards for confined spaces, gas measurement and testing personnel in confined spaces, supervisors, commanders, licensers.
- Assuming responsibility for issuing safety and hygiene procedures when performing work related to confined spaces and other work control procedures if necessary to ensure safety for individuals working in confined spaces.
- Ensuring that supervisors, commanders, licensers, individuals entering confined spaces, guards for confined spaces are trained in occupational safety and hygiene in accordance with section 4.2 of this standard.
Therefore, the conditions regarding competency, minimum standards for the licensor to work in confined spaces will be regulated by the employer.
