This article helps you understand the legal regulations regarding the implementation of standard contracts and general transaction conditions under Vietnam's consumer protection laws. These regulations not only protect consumer rights but also ensure transparency and fairness in commercial transactions.
According to the provisions of Article 26 of the Law on Consumer Protection, it is stipulated as follows:
1. Business organizations and individuals must spend reasonable time for consumers to study the contract before entering into a form contract.
2. Business organizations and individuals must keep the contract according to the signed form until the contract expires. In case the contract kept by the consumer is lost or damaged, within 07 working days from the date of receiving the request from the consumer, the business organization or individual is responsible for providing a copy of the contract. .
3. Form contracts must be publicly disclosed by business organizations and individuals in the form of posting in a visible position at headquarters, business locations and posted on electronic information sites and application software. (if any) so that consumers know about the content of the contract before the consumer signs the contract or makes a deposit or payment before the contract is signed.
According to the provisions of Article 27 of the Law on Consumer Protection, it is stipulated as follows:
1. Business organizations and individuals using general trading conditions have the responsibility to disclose and must spend reasonable time for consumers to study the general trading conditions before trading.
2. General trading conditions must clearly state the time of application and must be publicly disclosed by business organizations and individuals in the form of posting in a visible position at headquarters, business locations and posted on the website. Electronic information page and application software (if any) to let consumers know about the content of general trading conditions.
3. General trading conditions are only valid for consumers in cases where the general trading conditions have been made public so that consumers know about those conditions before the transaction.
According to the provisions of Article 31 of the Law on Consumer Protection, it is stipulated as follows:
1. Business organizations and individuals are responsible for receiving and resolving feedback, requests and complaints from consumers.
2. Business organizations and individuals are responsible for notifying consumers of receiving feedback, requests, and complaints from consumers within 03 working days from the date of receiving feedback and requests. requests and complaints.
3. Organizations and individuals that produce or import products and goods or directly sell and provide products, goods and services to consumers are responsible for building and publicizing the process of receiving and resolving issues. Resolve feedback, requests, and complaints of consumers in the form of posting in a visible location at headquarters, business locations and posting on the website and application software (if any). .
The provisions in this Clause are not required to apply to individuals conducting independent, regular commercial activities, not requiring business registration, and all micro-enterprises according to the provisions of law.
