Current regulations still have many legal loopholes and do not strictly control these two types. The Electronic Transactions Law and current guiding documents do not cover all business models. For cross-border sales, regulations on taxes, customs, and consumer protection in cross-border transactions are still general and have not kept up with actual developments. Current law lacks an effective monitoring mechanism for new business models. The "virtual" nature of the network environment makes collecting evidence of violations in e-commerce difficult. State management agencies still lack technologically knowledgeable human resources to effectively monitor e-commerce activities, especially with complex new forms.
Sanctions also need to be stronger. Current fines for violations in e-commerce are not enough of a deterrent, causing violations to still occur commonly. Due to the cross-border nature of some transactions, enforcement of sanctions against overseas entities also faces many difficulties. Therefore, there needs to be a close coordination mechanism between management agencies in handling violations and protecting consumer rights.
