Applying for a single house construction permit in Vietnam requires thorough preparation of necessary documents. In 2023, the requirements for permit applications have been updated to ensure legality and efficiency in the construction process. This article provides detailed guidance on the documents needed, helping you navigate the permit application process quickly and in compliance with regulations.
Pursuant to Article 46 of the Decree 15/2021/ND-CP, application documents for construction permits for individual houses include:
- Application for construction permit as prescribed in Model number 01.
- One of the documents proving land use rights according to the provisions of land law.
- 02 sets of construction design drawings accompanied by a Certificate of design approval for fire prevention and fighting together with approval drawings in case the law on fire prevention and fighting requires it; Report on the results of construction design verification in cases where construction law requires, including:
+ Drawing of the construction site on the land lot, accompanied by a construction location diagram;
+ Floor plans, elevations and main cross-sections of the building;
+ Foundation plan drawing and foundation cross section together with connection diagram of the technical infrastructure system outside the building including water supply, drainage, and electricity supply;
+ For construction projects with adjacent structures, there must be a written commitment to ensure safety for the adjacent structures.
Note: The Provincial People's Committee publishes sample design drawings for households and individuals to refer to when making their own construction designs.
The 3 types of applications for individual housing construction permits according to each construction category mentioned above apply to all types of individual housing projects such as villas, townhouses, and independent houses (houses). level 1, level 2 housing, level 3 housing and level 4 housing).
Step 1. Submit application for individual house construction permit
Individuals/organizations/households prepare 2 sets of documents corresponding to construction needs according to the instructions above and then submit directly to the district People's Committee where the housing is expected to be built.
Step 2. The district People's Committee reviews and processes the application
➨ Receive and check documents
➨ Document appraisal and field inspection
➨ Ask for advice from state management agencies
The district-level People's Committee compares the conditions for applying for a housing construction permit with the provisions of the 2014 Construction Law and sends documents to seek opinions from state management agencies on fields related to housing projects. .
Note:
The maximum processing time is 12 working days from the date of receipt of the written request for comments. If after the above deadline, the district People's Committee still does not receive a written response from the state management agency, it is considered to have agreed and taken responsibility for the content within its management function.
Step 3. Receive a license to build individual houses
After receiving the written response from the state management agency on the dossier requesting opinions for individual housing construction projects, based on current regulations, the district People's Committee issues a decision:
