This article introduces 07 main subjects that have the right to exploit credit information in Vietnam. These subjects include financial institutions, banks, insurance companies, credit card companies, state management agencies, auditing companies and individual customers. Understanding these subjects helps you grasp how credit information is used and protect your personal rights.
According to Clause 2, Article 3 of Circular 03/2013/TT-NHNN, credit information is information about borrowers and information related to borrowers at credit institutions and foreign bank branches.
Subjects of credit information exploitation include:
(1) State management agencies exploit credit information products to directly serve professional activities of inspection, supervision, investigation, prosecution, trial, execution of judgments; investigation, social statistics and other purposes as prescribed by law.
(2) Units under the State Bank exploit credit information products to serve the State management requirements of the State Bank.
(3) Credit institutions and foreign bank branches exploit credit information services to serve the needs of finding customers, assessing customers' debt repayment ability, managing credit risks and other banking operations.
(4) Organizations voluntarily exploit credit information services for the purpose of customer assessment and other purposes as prescribed by law.
(5) Borrowers use credit information services to check information about themselves and serve other purposes as prescribed by law.
(6) In addition to the subjects specified in the above clauses, organizations or individuals exploiting credit information services about borrowers must have the written consent of that customer.
(7) Foreign credit information organizations are allowed to exploit credit information products about enterprises, including information made public according to the provisions of law on the basis of memorandums of understanding, cooperation agreements, and service contracts signed with CIC.
