According to Article 7 of Decree 142/2021/ND-CP, the rights and obligations of people subject to the penalty of expulsion are specifically stipulated as follows:
Rights and obligations of people subject to the penalty of expulsion
1. A person subject to the penalty of expulsion has the right to:
a) Be informed of the reason for deportation and receive the deportation decision at least 48 hours before execution;
b) Be required to have an interpreter when working with competent authorities or persons;
c) Be entitled to the regimes prescribed in Decree No. 65/2020/ND-CP dated June 10, 2020 regulating the organization and regimes for people staying at accommodation establishments while waiting for exit;
d) Be allowed to bring their legal assets out of Vietnam's territory;
d) To make complaints and denunciations in accordance with the provisions of law on handling complaints and denunciations.
2. Obligations of the deported person:
a) Fully comply with the provisions stated in the decision on administrative sanctions that apply the penalty of expulsion;
b) Present identification documents as required by immigration authorities;
c) Comply with the provisions of Vietnamese law and be subject to the management of the police during the deportation procedures;
d) Promptly and fully comply with civil, administrative and economic obligations as prescribed by law (if any);
d) Complete the necessary procedures to leave Vietnamese territory.
Thus, based on the above provisions, foreigners subject to the penalty of deportation have the following rights:
- Be informed of the reason for deportation and receive the deportation decision at least 48 hours before execution.
- Be required to have an interpreter when working with authorities and competent persons.
- Implement the regimes prescribed in Decree 65/2020/ND-CP regulating the organization and regimes for people staying at accommodation establishments while waiting for exit.
- Be allowed to bring your legal assets out of Vietnam.
- To make complaints and denunciations according to the provisions of law on handling complaints and denunciations.
