Regulations on extending the validity of protection certificates (VBBH) are very important in protecting intellectual property rights. This article will provide detailed information on the relevant legal regulations, helping you better understand the process and requirements needed to extend the validity of protection certificates, ensuring that your rights are maximally protected.
A certificate of trademark registration is valid from the date of issuance until the end of 10 years from the date of application, and can be renewed many consecutive times, each time for 10 years for all or part of the list of goods and services.
To extend the validity of the insurance policy, the insurance policy holder must submit an application for extension within 06 months from the date the insurance policy expires. The application for extension can be submitted late but not later than 06 months from the date the insurance policy expires and the insurance policy holder must pay an additional late extension fee.
- The application for extension of validity of VBBH includes:
+ Application form for extension of validity of VBBH (according to form No. 07, Appendix II, Decree 65/2023/ND-CP) (Attached form).
+ Original VBBH (in case of requesting to record the extension in VBBH);
+ Power of attorney (in case of submitting request through representative);
+ Copy of documents for payment of fees and charges as prescribed;
+ Other documents (if necessary).
- Review period: 01 month from the date of application
- Implementation result: Issue a Decision to record the extension of the validity of the Certificate of Registration and publish it in the Industrial Property Gazette or a Decision to refuse the extension of the validity of the Certificate of Registration. Update the extension content to the original Certificate of Registration (if any) and return the certificate to the owner.
- Fees:
+ Renewal fee: 100,000 VND/group
+ Late renewal fee: 10% renewal fee/each month late
+ Fee for appraisal of extension request: 160,000 VND/VBBH
+ VBBH usage fee: 700,000 VND/group
+ Fee for announcing the Decision on recording the extension: 120,000 VND/application
+ Registration fee for Decision to extend the validity of the insurance certificate: 120,000 VND/insurance certificate
