Domestic solid waste treatment is an important part of protecting the environment and public health. Regulations on domestic solid waste treatment aim to ensure that waste is collected, transported and treated properly, minimizing negative impacts on the environment. Vietnamese law has issued many detailed regulations on this issue, from waste classification at source to the application of advanced treatment technology. This article will provide detailed information on current regulations, helping you better understand your responsibilities and obligations in the treatment of domestic solid waste.
According to Clause 8, Article 3 of Decree 08/2022/ND-CP, waste treatment is the process of using technological and technical solutions (different from preliminary processing) to reduce, eliminate, isolate, quarantine, incinerate, destroy, and bury waste and harmful elements in waste.
The treatment of domestic solid waste according to Article 78 of the Law on Environmental Protection 2020 stipulates as follows:
- The State encourages and has preferential policies for organizations and individuals participating in investing and providing domestic solid waste treatment services; encourages co-treatment of domestic solid waste.
- People's Committees at all levels shall select domestic solid waste treatment facilities through bidding in accordance with the provisions of the law on bidding; in cases where it is not possible to select through bidding, it shall be implemented in the form of ordering or assigning tasks in accordance with the provisions of the law.
- Facilities providing domestic solid waste treatment services must meet environmental protection requirements as prescribed. Investment in facilities providing domestic solid waste treatment services that only serve the area of a commune-level administrative unit is discouraged.
- Domestic solid waste must be treated with appropriate technology, meeting environmental technical standards. The Government stipulates a roadmap to limit the treatment of domestic solid waste by direct landfill technology.
- The Minister of Natural Resources and Environment issues criteria on domestic solid waste treatment technology; guides models for domestic solid waste treatment in urban and rural areas.
- The provincial People's Committee is responsible for planning and allocating land for domestic solid waste treatment areas, and promptly allocating land to implement the construction and operation of domestic solid waste treatment areas in the area;
Allocate funds for investment in construction and operation of systems for collection, storage, transfer, transportation and treatment of domestic solid waste; systems of public works, measures and equipment serving the management of domestic solid waste in the area.
