Regulations on issuing copies/re-issuing Certificates of registration of contracts for transfer of rights to use industrial property objects

Issuing a copy or reissuing a Certificate of registration of a contract for the transfer of the right to use an Industrial Property (IP) object is a necessary procedure when the original certificate is lost, damaged or a copy is needed for use. The implementation of these procedures must comply with legal regulations to ensure the legality and rights of the parties involved. - The application file for a copy/re-issuance of the Certificate of registration of a contract for transferring the right to use an intellectual property object includes:

+ Application form for issuance of duplicate/re-issuance of Certificate of registration of contract for transfer of right to use industrial property object (according to form No. 09 in Appendix II of Decree 65) (Attached form);

+ Power of attorney (in case of submitting request through representative);

+ Copy of documents for payment of fees and charges as prescribed;

+ Other documents (if necessary).

- Review period: 01 month from the date of application

- Implementation result: Issue a Decision to issue a duplicate/reissue the Certificate of registration of the contract for transferring the right to use the intellectual property object and publish it in the Intellectual Property Gazette or a Decision to refuse to issue a duplicate/reissue the Certificate of registration of the contract for transferring the right to use the intellectual property object. Return the duplicate/reissue the Certificate of registration of the contract for transferring the right to use the intellectual property object to the applicant.

- Fees:

+ Fee for announcing the Decision to issue a copy/reissue the Certificate of registration of the contract to transfer the right to use the IP object: 120,000 VND/application

+ Registration fee for Decision on issuance of duplicate/re-issuance of Certificate of registration of contract for transfer of right to use SHCN object: 120,000 VND/VBBH

+ Service fee (temporarily not collected, will be collected later when there are specific regulations).
