In Decision 1050/QD-BTP of 2021 of the Ministry of Justice on promulgating amended and supplemented administrative procedures in the field of criminal records under the management scope of the Ministry of Justice, the procedure for issuing criminal records to Vietnamese citizens and foreigners residing in Vietnam is prescribed as follows:

“1. Procedures for issuing Criminal Records to Vietnamese citizens and foreigners residing in Vietnam

Vietnamese citizens submit to the Department of Justice where they permanently reside; in case they do not have a permanent residence, submit to the Department of Justice where they temporarily reside; in case they reside abroad, submit to the Department of Justice where they resided before leaving the country.

Foreigners residing in Vietnam must submit to the Department of Justice where they reside.

- Profile components[3]:

+ Application form for issuance of Criminal Record Certificate according to prescribed form (Form No. 03/2013/TT-LLTP; Form No. 04/2013/TT-LLTP).

+ Photocopy of the Identity Card or Citizen Identification Card or Passport of the person issued with the Criminal Record Certificate (In case of submitting a photocopy, the original must be presented for comparison. In case of not having the original for comparison, a certified copy must be submitted in accordance with the provisions of law).

+ Authorization document in case of authorizing another person to carry out the procedure to request the issuance of Criminal Record Certificate No. 1[4] (in case the authorized person is the father, mother, wife, husband, or child of the authorizing person, an authorization document is not required). The authorization document must be notarized and certified according to the provisions of Vietnamese law".

Thus, according to Decision 1050/QD-BTP in 2021, the dossier components for the procedure of issuing a Criminal Record Certificate for foreigners residing in Vietnam include:

- Application form for Criminal Record Certificate.

- A photocopy of the passport of the person issued with a Criminal Record Certificate (In case of submitting a photocopy, the original must be presented for comparison. In case of not having the original for comparison, a certified copy must be submitted in accordance with the provisions of law).

- Authorization document in case of authorizing another person to carry out the procedure to request the issuance of Criminal Record Certificate No. 1 (in case the authorized person is the father, mother, wife, husband or child of the authorizing person, no authorization document is required). The authorization document must be notarized and certified according to the provisions of Vietnamese law.
