According to Article 11 of the Law on Technology Transfer 2017, there are regulations on technologies prohibited from transfer, accordingly:
- Prohibit the transfer from foreign countries to Vietnam and the domestic transfer of the following technology:
+ Not complying with legal regulations on labor safety, labor hygiene, ensuring human health, protecting resources, environment and biodiversity;
+ Creating products that cause negative consequences to socio-economic development; negatively affecting national defense, security, social order and safety;
+ Technology; machinery and equipment accompanying the technology are no longer commonly used and transferred in developing countries and do not meet national technical standards and regulations;
+ Technology using toxic chemicals or generating waste that does not meet national environmental standards and technical regulations;
+ Using radioactive substances, creating radioactive substances that do not meet national technical standards and regulations.
- Prohibiting the transfer from Vietnam to foreign countries of technology on the List of State secrets, except in cases where other laws permit the transfer.
