Prohibited acts in the latest Vietnam Construction Law 2024

Conduct is strictly prohibited in Latest Construction Law 2024 include:

- Construction investment decisions are not in accordance with regulations Construction Law 2014.

- Starting construction when the conditions for starting construction are not met according to regulations Construction Law 2014.

- Construction works in prohibited construction areas; Construction of works that encroach on the protection corridors of national defense, security, traffic, irrigation, dykes, energy works, historical and cultural relics and other work protection areas according to the provisions of law; Construction works in areas that have been warned about the risk of landslides, flash floods, and pipe floods, except for construction works to overcome these phenomena.

- Construction of works not in accordance with construction planning, unless there is a construction permit with a term; violating construction boundaries and building cores; Construction works not in accordance with the issued construction permit.

- Prepare, appraise, and approve designs and estimates of construction projects using state capital contrary to regulations of the law. Construction Law 2014.

- Contractors participating in construction activities when they do not meet the qualifications to carry out construction activities.

- The investor chooses a contractor who is not qualified to carry out construction activities.

- Construction of works that do not comply with the standards and technical regulations selected to apply to the project.

- Producing and using construction materials that are harmful to public health and the environment.

- Violation of regulations on labor safety, property, fire and explosion prevention and control, security, order and environmental protection in construction.

- Using the building not in accordance with its purpose and function; Building expansions, encroaching on areas, encroaching on spaces that are legally managed and used by other organizations, individuals and public areas and common use areas.

- Giving or receiving bribes in construction investment activities; taking advantage of other legal entities to participate in construction activities; Arranging and colluding to falsify the results of project planning, surveying, design, and construction supervision.

- Abusing positions and powers to violate construction laws; covering up and delaying handling of violations of construction laws.

- Obstructing legal construction investment activities.
