Procedures for foreigners and Vietnamese people holding foreign passports

1. How to do:

Step 1: Prepare documents according to the law.

Step 2: Submit application:

1. Agencies, organizations and individuals submit their applications at one of the two working offices of the Immigration Department - Ministry of Public Security:

a) 44-46 Tran Phu, Ba Dinh, Hanoi.

b) 333-335-337 Nguyen Trai, District 1, Ho Chi Minh City.

2. The officer receiving the application checks the legality and content of the application:

+ If complete and valid, receive the application, print and give a receipt, and schedule a date to return the results.

+ If the application is invalid, the officer receiving the application will guide the applicant to supplement the application to complete it.

Application deadline:

- From Monday to Saturday morning every week (except New Year's Day and holidays).

Step 3: Get results:

a) The person coming to receive the results must present the receipt, ID card or passport to the officer returning the results for verification and comparison. If the temporary residence card is issued, the person must pay the fee, then sign and give the temporary residence card to the person coming to receive the results (even if it is not approved).

b) Time to return results: From Monday to Friday every week (except holidays).

2. Components and number of documents:

+ Profile components:

a) Application for temporary residence card (form NA6 for agencies and organizations, NA7 for individuals);

b) Application form for temporary residence card for foreigners (NA8)

c) Documents proving eligibility for consideration for temporary residence card issuance are one of the following types of documents: work permit or other documents with value proving eligibility for temporary residence card issuance;

d) 02 2x3 cm photos (01 photo attached to the declaration form, 01 separate photo);

+ Number of documents: 01 (one) set.

- Processing time: no more than 05 working days from the date of receipt of complete documents.

- Subjects performing administrative procedures: Vietnamese agencies, organizations and citizens.

- Administrative procedure performing agency: Immigration Department, Ministry of Public Security.

- Results of administrative procedure implementation: temporary residence card

- Fees/Charges (if any):

+ Temporary residence card with validity of no more than 02 years: 145 USD/card

+ Temporary residence card with validity from 02 years to 05 years: 155 USD/card

+ Temporary card with validity from 5 years to 10 years: 165 USD/card

- Name of application form, declaration form (if any):

+ Official dispatch requesting temporary residence card (form NA6 for agencies and organizations, NA7 for individuals);

+ Declaration of information about foreigners requesting temporary residence card (form NA8);

- Requirements and conditions for performing administrative procedures (if any):

1. Agencies and organizations, when requesting to issue temporary residence cards to foreigners, must submit documents proving legal status to the Immigration Department, Ministry of Public Security.

a) License or Decision of the competent authority on the establishment of the organization (notarized);

b) Document registering the organization's activities (notarized) issued by the competent authority of the People's Committee of the province or centrally-run city;

c) Letter of introduction, seal and signature of the legal representative of the organization;

The above application is only submitted once. When there is a change in the application content, the enterprise must notify the Immigration Department in writing to supplement the application.

2. Foreigners entering the country for purposes of activities in accordance with the provisions of Vietnamese law, and are not subject to "temporary suspension of exit" as prescribed in Article 28 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam.

3. Legal basis of administrative procedures:

+ Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (Law No. 47/2014/QH13, dated June 16, 2014).

+ Law amending and supplementing a number of articles of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (Law No. 51/2019/QH14, dated September 25, 2019).

+ Circular No. 04/2015/TT-BCA, dated January 5, 2015 of the Ministry of Public Security stipulating forms of documents related to entry, exit and residence of foreigners in Vietnam.

+ Circular No. 57/2020/TT-BCA dated June 10, 2020 amending and supplementing a number of articles of Circular No. 04/2015/TT-BCA dated January 5, 2015 of the Ministry of Public Security stipulating forms of documents related to entry, exit, transit, and residence of foreigners in Vietnam.

+ Circular No. 25/2021/TT-BTC dated April 7, 2021 of the Ministry of Finance stipulating the collection rates, collection, payment, management and use of fees and charges in the fields of exit, entry, transit and residence in Vietnam.
