This article provides detailed information on the procedure for obtaining practitioner certificates for individuals and operational licenses for healthcare facilities in Vietnam. Understanding this process helps individuals and healthcare facilities prepare the necessary documents and comply with legal regulations to be licensed to practice and operate.
Article 28 of the Law on Medical Examination and Treatment 2009 and Article 7 guiding the issuance of practice certificates to practitioners and operating licenses to medical examination and treatment establishments stipulate the order and procedures for granting practice certificates. y is done as follows:
Step 1:
- The applicant for a practicing certificate is a person working at a medical examination and treatment facility under the Ministry of Health; People working at medical examination and treatment facilities belonging to other ministries, except for the cases specified in Clauses 2 and 3, Article 26 of the 2009 Law on Medical Examination and Treatment; Foreigners coming to practice medical examination and treatment in Vietnam send 01 set of documents to the Department of Medical Examination and Treatment Management - Ministry of Health;
- The applicant for a practicing certificate is a person working at a medical examination and treatment facility in the area of management, except for the cases specified in Clauses 1 and 3, Article 26 of the Law on Medical Examination and Treatment, and sends 01 set of documents to Provincial Department of Health.
Step 2:Procedure for considering requests for practice certificates
a) After receiving the application for a practicing certificate, the Ministry of Health or the Provincial Department of Health (hereinafter referred to as the application receiving agency) will send the application for a practicing certificate to the receiving certificate. documents as prescribed in Appendix 03 issued with Circular 41/2011/TT-BYT guiding the issuance of practice certificates to practitioners and operating licenses to medical examination and treatment facilities;
b) Within 60 days from the date of receipt of complete documents, the Minister of Health or the Minister of National Defense or the Director of the Department of Health must issue a practice certificate; In cases where verification is required for people who have been trained abroad or have a practicing certificate issued by a foreign country, the time limit may be longer but must not exceed 180 days; If a practicing certificate is not issued, a written response must be given and the reason must be stated.
Within 30 days from the date of receipt of complete documents, the Minister of Health or the Minister of National Defense or the Director of the Department of Health must re-issue the practice certificate; If the practicing certificate is not re-issued, a written response must be given and the reason must be stated.
c) In case the application for a practicing certificate is not valid, within 10 working days from the date recorded on the application receipt, the agency receiving the application must notify the applicant in writing. Request a practicing certificate to complete the dossier. The written notice must specifically state what documents are added and what content is amended;
Upon receiving a written request to complete the dossier, the applicant for a practicing certificate must amend and supplement according to the contents recorded in the document and send it to the dossier-receiving agency. The date of receipt of additional documents is recorded on the Application Receipt Form. If the agency receiving the application does not have a written request for amendment or supplementation, it must issue a practice certificate within the prescribed time;
In case the applicant for a practicing certificate has supplemented the dossier but does not meet the requirements, the agency receiving the dossier will notify the practicing certificate applicant to continue completing the dossier according to regulations. ;
Step three: Establish an advisory council
The Minister of Health established an Advisory Council with the participation of representatives of socio-professional medical organizations, legal associations, medical training establishments, medical examination and treatment establishments, and social organizations. Association for the Protection of Consumer Rights and a number of other social organizations to advise the Minister of Health in granting and developing standards for recognizing the content and forms of continuously updating medical knowledge. and conditions for facilities to update medical knowledge custom; regulate the content, form and organization of testing to confirm in writing people who know Vietnamese fluently and people who are qualified to interpret in medical examination and treatment.
The Director of the Department of Health established an Advisory Council with the participation of representatives of social and professional medical organizations, legal associations, medical training establishments, medical examination and treatment establishments, and social organizations. Association for the Protection of Consumer Rights and a number of other social organizations to advise the Director of the Department of Health in issuing practice certificates.
Step four: Issuance of practicing certificate
Practicing certificate issued by the Minister of Health or Director of the Provincial Department of Health according to the form specified in Appendix 04 and according to the code specified in Appendix 05 issued with Circular 41/2011/TT-BYT and Each individual is only granted one practice certificate. Practicing certificate copies are managed and provided by the Ministry of Health.
Copies of the practicing certificate and dossiers requesting issuance and re-issuance of the practicing certificate are kept at the practicing certificate-issuing agency.
