Registering a trademark via paper application is a popular choice for many businesses seeking to protect their brand. This process involves steps from preparing complete documentation, submitting the application to the competent authority, to monitoring and addressing any additional requirements if necessary. This article provides a detailed guide on each step of the paper application trademark registration procedure, helping you execute effectively and secure legal rights for your brand.
According to the guidance of the National Office of Intellectual Property, there are 02 forms of applying for trademark registration as follows:
- Submit your application directly at the National Office of Intellectual Property Headquarters or Representative Offices through the following addresses:
+ Head office of the Department of Intellectual Property, address: 386 Nguyen Trai, Thanh Xuan district, Hanoi city.
+ Representative office of the National Office of Intellectual Property in Ho Chi Minh City, address: No. 31 Han Thuyen, Ben Nghe Ward, District 1, Ho Chi Minh City.
+ Representative office of the Department of Intellectual Property in Da Nang city, address: 3rd floor, 135 Minh Mang, Khue My ward, Ngu Hanh Son district, Da Nang city.
- Submit the application via postal service to one of the application receiving points of the National Office of Intellectual Property.
Trademark registration procedures will be carried out according to the following steps:
- Step 1: Look up the trademark
+ Before submitting a trademark registration application, the applicant needs to check whether the trademark intended to be registered is identical or similar to other trademarks to avoid wasting time and money.
+ You can do a free preliminary search on http://iplib.noip.gov.vn/WebUI/WSearch.php or a paid search from the National Office of Intellectual Property.
- Step 2: Prepare registration documents
- Step 3: Pay the registration fee and go to the competent authority to submit the application or submit it via postal service.
- Step 4: Receive the decision to accept the application form. In case the registration application is requested to be amended, it shall be amended according to the instructions.
- Step 5: Receive application publication in the Industrial Property Official Gazette.
- Step 6: Receive notice of intention to grant a trademark protection certificate, pay the registration fee, publish the protection certificate and the fee for granting a trademark registration certificate.
- Step 7: Receive trademark registration certificate.
