Pursuant to Clauses 4 and 5, Article 30 of the Law on Medical Examination and Treatment 2023, the documents and procedures for obtaining a nursing practice license are currently prescribed as follows:
– Application for new nursing practice license (using form No. 08 of Appendix I issued with Decree 96/2023/ND-CP);
– Documents proving that the conditions in Clause 2, Article 30 of the Law on Medical Examination and Treatment 2023 have been met for the position of nurse. Specifically, the conditions include:
Assessed as competent to practice nursing through a professional competency assessment test or has a recognized practice license according to Article 29 of the Law on Medical Examination and Treatment 2023.
Have sufficient health conditions to practice nursing.
Meet Vietnamese language proficiency requirements for foreigners.
Not falling into one of the cases of being prohibited from practicing medical examination and treatment as stated in Article 20 of the Law on Medical Examination and Treatment 2023 or being administratively sanctioned for acts of medical examination and treatment without a practice license whose term has not expired is considered not to have been administratively sanctioned.
Step 1: The person applying for a nursing practice license submits all of the above documents to the competent authority that issues nursing practice licenses.
Step 2: Within 30 days from the date of receipt of the complete application, the competent authority must issue a nursing practice license to the applicant. In case of refusal to issue a practice license, a written response must be provided, stating the reasons for the refusal.
In case the competent authority needs to verify documents with foreign elements in the application for a nursing practice license, the time limit for granting a practice license to the applicant is 30 days from the date of verification results.
According to the provisions of Clause 2, Article 27 of the Law on Medical Examination and Treatment 2023, the license to practice medical examination and treatment is valid for 05 years.
Nursing practice license is one of the practice licenses for examination, treatment, therefore the term is 05 years.
*Note: From January 1, 2024, medical practice certificates must be converted into practice licenses. Law No. 15/2023/QH15 on medical examination and treatment of the National Assembly takes effect from January 1, 2024, which provides for the transition of converting practice certificates into practice licenses.
