This article provides information about a new landlord’s rights to increase the rent before the tenant’s lease has expired. It explains the relevant legal provisions, helping tenants understand their rights and ensure that their lease is performed in accordance with the law.
Pursuant to Article 133 of the 2014 Housing Law, regulations on right to continue renting housing as follows:
“1. In case the homeowner dies while the rental period is still in effect, the tenant may continue to rent the house until the end of the contract. The heir shall be responsible for continuing to perform the previously signed rental contract, unless otherwise agreed by the parties. In case the homeowner does not have a legal heir as prescribed by law, the house shall be owned by the State and the tenant may continue to rent the house in accordance with the regulations on management and use of state-owned houses.
2. In case the homeowner transfers ownership of the rented house to another person while the rental term is still valid, the lessee may continue to rent the house until the end of the contract; the new homeowner is responsible for continuing to perform the previously signed rental contract, unless the parties have another agreement.
3. When the lessee dies while the housing lease term is still in effect, the person living with the lessee may continue to rent the housing until the end of the housing lease contract, except in the case of renting official housing or the parties have another agreement or the law provides otherwise.
Thus, when the tenant's lease has not expired, he/she can continue to rent until the end of the contract.
The new homeowner is responsible for continuing to perform the previously signed housing lease contract, unless the parties have another agreement.
Therefore, unless otherwise agreed by the parties, the new homeowner must continue to perform the previously signed housing lease contract.
This also means that the new homeowner cannot increase the rent (unless otherwise agreed by the parties).
