Starting January 1, 2024, the conditions for practicing medicine in Vietnam will undergo significant changes. Discover the details of these new requirements and how they affect doctors and healthcare professionals.
License to practice medical examination and treatment (or license to practice medicine) is a document issued by a competent Vietnamese agency to a person who is qualified to practice medical examination and treatment according to the provisions of law.
According to regulations in Law on Medical Examination and Treatment 2023 (effective from January 1, 2024), individuals are allowed to practice medical examination and treatment in Vietnam when they fully meet the following conditions:
(i) Have a valid professional license;
(ii) Has registered to practice, except for the cases specified in Clause 3, Article 36 of this Law;
(iii) Meets requirements on language use in medical examination and treatment specified in Article 21 of this Law;
(iv) Be healthy enough to practice according to regulations of the Minister of Health;
(v) Not subject to the following cases prohibited from practicing medical examination and treatment:
+ Being prosecuted for criminal liability for violations of law related to technical expertise.
+ Currently serving a suspended sentence or non-custodial reform sentence for violations of the law related to technical expertise.
+ Being on probation for people sentenced to imprisonment related to technical expertise but released from prison before the term with conditions.
+ Are serving a prison sentence or are being subjected to administrative measures such as being sent to a compulsory education facility or a mandatory detoxification facility.
+ Being banned from practicing medical examination and treatment according to a legally effective criminal judgment of a court or restricted from performing medical examination and treatment activities according to a decision of a competent authority.
+ Loss of civil act capacity or difficulty in cognition, behavior control or limited civil act capacity.
2. Individuals are entitled to medical examination and treatment without meeting conditions (i), (ii) and (iii) above in the following cases:
- Trainees, students, students studying at training facilities in the health sector, people who are practicing medical examination and treatment to get a practice license, people who are waiting for a license practice and only be able to examine and treat diseases under the supervision of a practitioner;
- Village health workers, village midwives or health workers working at health agencies, units or organizations that do not establish medical examination and treatment facilities are only allowed to examine and treat diseases. within the scope of operations and after completing the training program according to the professional content and operations prescribed by the Minister of Health;
- The following objects:
+ Medical examination and treatment practitioners, including foreigners practicing in Vietnam;
+ Foreigners and Vietnamese residing abroad who have been granted practice licenses by competent foreign agencies and organizations;
+ Students, students, and students studying at training establishments in the health sector; People who are subject to a license to practice medical examination and treatment but have not yet been granted a license to practice.
- Other subjects participating in the medical examination and treatment process according to Government regulations.
Foreigners and Vietnamese residing abroad who have a practice license issued by a competent foreign agency or organization are entitled to humanitarian medical examination and treatment in batches, and cooperate in medical training with Practicing medical examination and treatment or transferring professional techniques in medical examination and treatment according to the provisions of this Law without meeting conditions (i) and (ii) above.
People participating in community first aid who are not out-of-hospital emergency responders do not have to meet the above conditions.
