According to the provisions of Article 103 of the 2013 Law on Medical Examination and Treatment on professional liability insurance in medical examination and treatment, it is stipulated as follows:
“Professional liability insurance in medical examination and treatment
1. Professional liability insurance in medical examination and treatment is a type of insurance used to pay compensation costs for damages caused by medical accidents during the medical examination and treatment process occurring within the insurance period and legal litigation costs related to such medical accidents, except for the cases specified in Point d, Clause 2, Article 100 of this Law.
2. The insurance company is responsible for paying the compensation costs specified in Clause 1 of this Article to the medical examination and treatment facility according to the signed insurance contract.
3. Professional liability insurance in medical examination and treatment is implemented according to the provisions of the law on insurance business.
4. The Government shall detail this Article.”
Accordingly, the insurance company that the medical examination and treatment facility has purchased insurance from is responsible for compensating the patient for damages according to the insurance contract signed with that medical examination and treatment facility, except in cases of medical accidents caused by the patient himself.
Law on Medical Examination and Treatment 2023 takes effect from January 1, 202024.
