This article provides detailed information about cases determined to be foreign element adoptive parents in Vietnam. From legal regulations to necessary procedures, the article helps readers understand more about situations considered to have foreign elements in the process of adopting as well as things to note to ensure the rights of both adoptive parents and children.
Based on Article 28 of the 2010 Law on Adoption, cases of adoptive parents with foreign elements are regulated as follows:
- Vietnamese residing abroad, foreigners residing in the same country who are members of international conventions on adoption with Vietnam accepting Vietnamese children as adoptive children.
- Vietnamese residing abroad, foreigners residing abroad are allowed to adopt specifically designated children in the following cases:
+ Stepfather, stepmother of the adoptee;
+ Aunts, uncles, cousins of the adoptee;
+ Having adoptive children who are siblings of the adopted children;
+ Accepting disabled, HIV/AIDS infected, or seriously ill children as adoptive children;
+ Foreigners working, studying in Vietnam for at least 01 year.
- Vietnamese citizens residing in the country accepting foreign children as adoptive children.
- Foreigners residing in Vietnam adopting children in Vietnam.
