Based on Article 33 of the 2010 Adoption Law which stipulates the responsibility to verify, confirm the dossier and confirm that the child meets the conditions to be considered for adoption as follows:
1. The Department of Justice is responsible for verifying the dossier, obtaining the opinions of those specified in Article 21 of this Law within 20 days from the date of receiving a complete and valid dossier. Obtaining opinions must be in writing and have the signature or markings of the person whose opinions are sought.
In case a child who has been abandoned needs to be verified, the Department of Justice requests the Provincial or Municipal Public Security to verify; the public security agency is responsible for verification and must respond in writing within 30 days from the date of receiving the request from the Department of Justice.
2. After verifying according to the regulations in paragraph 1 of this Article, if the child meets the conditions to be considered for adoption abroad, the Department of Justice confirms and sends it to the Ministry of Justice.
Based on Article 34 of the 2010 Adoption Law which stipulates the responsibility to verify and transfer the dossier of the adoptive parent as follows:
1. The Ministry of Justice is responsible for verifying and processing the dossier of the adoptive parent according to the regulations in paragraph 2 or paragraph 3 of this Article within 15 days from the date of receiving a complete and valid dossier.
2. In cases where the designated adoptive parent specified in paragraph 2 of Article 28 of this Law, the Ministry of Justice transfers the dossier to the Department of Justice where the person recommended as the adoptive parent resides for submission to the Provincial People's Committee for consideration and decision.
3. After the deadline for finding a substitute family for the child according to the regulations in paragraph 2 of Article 15 of this Law, if the child is not accepted for adoption by domestic adoptive parents, the Ministry of Justice transfers the dossier of the adoptive parent to the Department of Justice where the child is recommended as an adoptive parent for consideration, introduction of the child as an adoptive parent according to the procedures specified in Article 36 of this Law, except as provided in paragraph 2 of this Article.
