This article explains the procedures and regulations regarding the profile of a person introduced as a foreign adoptee in Vietnam. Learn in detail the legal requirements and necessary procedures to ensure a smooth process.
Article 32 of the Adoption Law regulates the profile of a person introduced as a foreign adoptee as follows:
1. The profile of a person introduced as a foreign adoptee includes:
a) Documents required under Article 18, Clause 1 of this Law (Profile of a person introduced as a domestic adoptee);
b) Documents on the characteristics, interests, notable habits of the children;
c) Documents proving that efforts have been made to find a substitute family for the children as stipulated in Clause 2 of Article 15 of this Law but have been unsuccessful.
2. The profile specified under this clause shall be prepared in 03 sets and submitted to the Department of Justice where the person introduced as an adoptee is a resident.
3. Biological parents or guardians shall prepare the profile of the person introduced as an adoptee living in the family; the nurturing facility shall prepare the profile of the children introduced as adoptees living at the nurturing facility.
* Article 14 of Decree No. 19/2011/ND-CP (amended, supplemented) regulates the profile of a person accepted as an adoptee as follows:
The profile of a person accepted as an adoptee must include documents prepared in accordance with Article 32 of the Adoption Law and the following specific provisions:
1. A summary of the characteristics, interests, habits of the children must truthfully record information about the health, medical conditions (if any) of the children, notable daily interests, habits of the children for the convenience of the adoptive parent in caring for, nurturing, educating the children after being accepted as adoptees.
In case a stepfather or stepmother adopts the spouse's biological child, this document is not required.
2. For children subject to the introduction procedure, the following documents must be provided:
a) Documents from the Department of Justice along with documents, records on efforts to inform finding a substitute family for the children as stipulated in point c, Clause 2 of Article 15 of the Adoption Law;
b) Confirmation letter from the Adoption Department on the expiration of the notification period as stipulated in point d, Clause 2 of Article 15 of the Adoption Law but no one in the country accepts the children as adoptees.
3. At the adoptee handover ceremony, the Department of Justice shall hand over to the foster parents 01 set of the children's profile including documents as stipulated in Clause 1 of Article 32 of the Adoption Law and documents seeking opinions of the biological parents or guardians and the opinions of the children aged nine and above on agreeing to be adopted; in case the children are living at the nurturing facility, there must be documents seeking the opinion of the Director of the nurturing facility regarding accepting the children as adoptees.
