Hazardous waste management requires strict compliance with legal regulations to protect the environment and human health. Hazardous waste generators must register with the authorities and comply with regulations on waste management, transportation and treatment. The responsibilities of the generator include ensuring safety during the treatment process and minimizing environmental risks. This article will provide detailed information on the registration regulations and responsibilities of hazardous waste generators, helping you better understand your legal obligations in this area.
1. Hazardous waste source owners are responsible for registering with the Department of Natural Resources and Environment in one of the following forms:
a) Prepare a registration file to be granted a Hazardous Waste Source Owner Registration Book (hereinafter referred to as the hazardous waste source owner registration procedure);
b) Integrated into hazardous waste management reports and not having to carry out hazardous waste source registration procedures for some special cases (in cases where the source owner has limits on the amount generated, type and duration of operation);
c) Register online through the information system with full information similar to the application form as prescribed in Point a, Clause 1 of this Article.
2. The procedure for registering hazardous waste source owners as prescribed in Point a, Clause 1 of this Article shall only be carried out once (no extension or adjustment) when hazardous waste generation activities begin. The registration book shall only be reissued in case of changes in the name of the waste source owner or address, number of hazardous waste generating facilities; changes or additions to the plan for self-reuse, recycling, co-treatment, treatment and recovery of energy from hazardous waste at the facility. After being granted the Waste Source Owner Registration Book, waste information shall be updated by periodic hazardous waste management reports.
3. The procedure for registering hazardous waste source owners is integrated with the registration of plans for self-reuse or pre-processing, recycling, treatment, co-treatment, and energy recovery from hazardous waste that meets environmental technical standards within the waste generating facility.
1. Register with the Department of Natural Resources and Environment where the facility generating hazardous waste is located as prescribed in Clause 1, Article 6 of Decree 08/2022/ND-CP.
2. Take measures to minimize the generation of hazardous waste; be responsible for identifying, classifying, and determining the quantity of hazardous waste that must be reported and managed.
3. Have a temporary storage area for hazardous waste; store hazardous waste in packaging or storage equipment that meets technical requirements and management procedures as prescribed.
4. In case of not reusing, recycling, co-processing, treating, or recovering energy from hazardous waste at the facility, the owner of the hazardous waste source must sign a contract to transfer hazardous waste with an organization or individual with a suitable license.
5. The owner of a hazardous waste source is responsible for periodically reporting every 6 (six) months on the storage of hazardous waste at the generating facility to the Department of Natural Resources and Environment in a separate document or in combination with the periodic hazardous waste management report when it has not been transferred in the following cases:
a) There is no feasible transportation and treatment plan;
b) Not yet found a suitable hazardous waste treatment facility.
6. Prepare, use, store and manage hazardous waste documents, hazardous waste management reports (periodic and ad hoc) and records, documents and diaries related to hazardous waste management according to regulations.
7. When ceasing activities generating hazardous waste, written notification must be given to the Department of Natural Resources and Environment where the hazardous waste generating facility is located within no more than 06 (six) months.
