This article answers questions about cases where foreigners do not need to apply for a work permit when working in Vietnam. Understand the specific conditions and circumstances that Vietnamese law stipulates in order to exempt work permits. This is important information to help foreign workers understand their rights and prepare better for work in Vietnam.
The cases in which foreigners are not required to obtain a Work Permit are stipulated in Article 7 of Decree 152/2020/NĐ-CP, including:
- Being the Head of office representative, project or having primary responsibility for the activities of international organizations, foreign non-governmental organizations in Vietnam.
- Entering Vietnam with a stay of less than 03 months to carry out service sales.
- Entering Vietnam with a stay of less than 03 months to deal with incidents, situations of complex technical, technological nature or effects that affect or are likely to affect production, business that Vietnamese experts and foreign experts currently in Vietnam cannot resolve.
- Being a foreign lawyer who has been granted a license to practice law in Vietnam in accordance with the Lawyers Law.
- Cases as stipulated by international treaties to which the Socialist Republic of Vietnam is a member.
- Foreigners married to Vietnamese and residing in Vietnamese territory.
- Being an owner or contributing member of a limited liability company with a capital value of 3 billion VND or more.
- Being the Chairperson of the Board of Directors or a member of the Board of Directors of a joint-stock company with a capital value of 3 billion VND or more.
- Moving within the enterprise of 11 service sectors within the commitment schedule of services of Vietnam to the World Trade Organization, including: business, information, construction, distribution, education, environment, finance, health, tourism, culture entertainment, and transport.
- Entering Vietnam to provide consulting services on expertise and technology or performing other tasks to serve research, construction, appraisal, monitoring evaluation, management and implementation of programs, projects using officially development assistance (ODA) in accordance with regulations or agreements in international ODA treaties signed between authorized agencies of Vietnam and foreign countries.

- Being granted a license to operate information activities, press in Vietnam by the Ministry of Foreign Affairs in accordance with the law.
- Being dispatched by foreign authorities, organizations to Vietnam to instruct, research at international schools under the management of foreign diplomatic missions or the United Nations; establishments, organizations established according to agreements that Vietnam has signed, participated in.
- Volunteer as stipulated in Clause 2, Article 3 of Decree 152/2020/NĐ-CP.
- Entering Vietnam to work in positions of managers, managing directors, experts or technical workers with a working time of less than 30 days and not exceed 03 times in 01 year.
- Entering Vietnam to implement international agreements that central, provincial-level agencies sign in accordance with the law.
- Students, students studying at foreign schools, training institutions with internships agreements with agencies, organizations, businesses in Vietnam; apprentice students, trainees on Vietnamese ships.
- Relatives of foreign diplomatic missions in Vietnam as stipulated in point l, Clause 1, Article 2 of Decree 152/2020/NĐ-CP.
- Having an official passport to work for state agencies, political organizations, socio-political organizations.
- Being responsible for establishing commercial presence.
- Being confirmed by the Ministry of Education and Training that foreign workers are coming to Vietnam to teach, research.
