Violations of environmental regulations in public places, urban areas, and residential zones can have serious consequences for public health and living environments. Improper transportation of materials and goods is also a cause of pollution. This article analyzes common violations and measures for remediation.
Article 25 of Decree No. 45/2022/ND-CP dated July 7, 2022 of the Government stipulating penalties for administrative violations in the field of environmental protection, stipulating penalties for violations of regulations on environmental protection Public schools, urban areas, residential areas; Transporting raw materials, materials and goods that cause environmental pollution, specifically as follows:
1. A warning shall be imposed for failure to post regulations on environmental hygiene in public places.
2. Penalties for collecting and disposing of waste against environmental protection regulations are as follows:
a) A fine from 100,000 VND to 150,000 VND shall be imposed for throwing, discarding, or discarding cigarette butts, butts, or butts in the wrong places in apartment buildings, commercial, service areas, or public places;
b) Fine from 150,000 VND to 250,000 VND for personal hygiene behavior (urination, defecation) not in the prescribed place in apartment buildings, commercial, service areas or public places;
c) Fine from 500,000 VND to 1,000,000 VND for acts of throwing, discarding, disposing of waste, dumping wastewater in improper places in apartment buildings, commercial, service areas or public places, except for violations specified in point d of this clause;
d) A fine from 1,000,000 VND to 2,000,000 VND shall be imposed for throwing, dumping, or disposing of waste on sidewalks, roadsides, or into the urban wastewater drainage system or surface water drainage system; improper dumping of wastewater on sidewalks and streets; Dispose of plastic waste generated from daily activities into ponds, lakes, canals, rivers, streams, and seas.
3. Fine from 2,000,000 VND to 4,000,000 VND for transporting raw materials without cover or letting them fall into the environment while participating in traffic.
4. A fine from 10,000,000 VND to 15,000,000 VND shall be imposed for not using specialized equipment and vehicles during the transportation of materials and goods that cause leakage or dispersion into the environment.
5. Fines from 10,000,000 VND to 20,000,000 VND for management activities of parks, amusement parks, entertainment areas, festivals, tourist areas, markets, railway stations, bus stations, wharfs, and ports , ferry terminals and other public areas have one of the following acts:
a) There are not enough public toilets, waste collection facilities and equipment to meet environmental hygiene requirements according to regulations;
b) Failure to collect waste within the scope of management according to regulations;
c) Failure to arrange human resources to collect waste and clean the environment within the scope of management; There are no officers, groups or environmental protection teams to inspect and supervise according to regulations.
6. A fine from 200,000,000 VND to 250,000,000 VND shall be imposed on investors building urban areas and concentrated residential areas who commit the following violations of environmental protection:
a) There is no separate rainwater and wastewater drainage network; There are no public restrooms that meet environmental protection requirements;
b) There is no synchronous wastewater collection and treatment system in accordance with the approved planning;
c) There is no equipment, means, or location to classify at source, collect, and store household solid waste appropriate to the amount and type of waste generated from households and individuals in residential areas. central;
d) Not ensuring the area of green trees, water surface, and open space in urban areas and concentrated residential areas according to regulations.
7. Remedial measures:
a) Forced restoration of original condition; If causing environmental pollution, measures must be taken to overcome environmental pollution caused by administrative violations in cases of violations at Points c and d, Clause 2, Clause 3 and Clause 4 of this Article;
b) Compulsory construction and installation of environmental protection works according to regulations within the time limit set by the person with sanctioning authority in the decision on sanctioning administrative violations for the violations specified in Point a, b, c Clause 6 of this Article;
c) Forced to take measures to overcome environmental pollution according to regulations and report the results of completing the remediation of violations within the time limit set by the person with sanctioning authority in the sanctioning decision. administrative violations caused by the violations specified in Clauses 5 and 6 of this Article.”
