Pursuant to Article 27 of Regulation 181-QD/TW of 2013, violations of regulations on professional ethics in the medical sector are regulated as follows:
- Party members who violate one of the following cases causing less serious consequences shall be disciplined by reprimand:
+ Violating regulations and rules on expertise in the medical industry.
+ Dishonesty in declaring and paying medical examination and treatment costs.
+ Discriminating against patients, having a patronizing attitude, abusing the profession and causing trouble and harassment to patients; refusing to examine and treat patients.
+ Giving patients poor quality medicine, expired medicine, medicine that does not match the requirements and severity of the disease.
+ Prescribe and instruct patients to buy medicine at the pharmacy, suggest transferring patients to related medical facilities to receive commission.
- In case of a violation that has been disciplined and re-offends or the first violation causes serious consequences or violates one of the following cases, the disciplinary action shall be in the form of a warning or dismissal from office (if holding a position):
+ Using patients as experimental subjects for diagnostic, treatment, and scientific research methods without permission from the Ministry of Health and the patient's consent.
+ Not wholeheartedly treating the patient, causing consequences for the patient.
+ Prescribing drugs to patients that are not consistent with their diagnosis and not ensuring the rational and safe use of drugs.
+ Having shortcomings and defects, not voluntarily taking responsibility for oneself, blaming colleagues and the front line.
+ Lack of responsibility in medical examination and treatment; requiring patients to come for examination and treatment at private medical facilities established by themselves or medical facilities established by themselves for personal gain.
+ Violating professional and technical regulations in medical examination and treatment, causing consequences for patients.
- In case of violating the above regulations causing very serious consequences or violating one of the following cases, the disciplinary action shall be in the form of expulsion:
+ Arbitrarily leaving the position while on duty, not monitoring and promptly handling the patient's condition leading to death.
+ Indifference, failure to promptly provide first aid, emergency care, diagnosis, and timely treatment for patients, leading to patient death.
+ Setting material conditions or blatantly extorting money from patients or their relatives during medical examination and treatment.
+ Erasing and modifying medical records to distort information with the responsibility of medical examination and treatment.
