Copyright ownership can include various entities, from individual authors to organizations and legal heirs. The author, as the creator of the work, is typically the initial copyright owner. However, in some cases, organizations or businesses may own copyright if the work is created during employment or under contract. Additionally, copyright can be transferred or inherited by others according to legal provisions.
Clause 2 Article 1 Intellectual Property Law 2005 (Intellectual property law amended and supplemented in 2009) regulations: "Copyright is the right of organizations and individuals to works they create or own."
Thus, copyright includes the specific rights that the law gives to the author or owner of a work to name the work, have a real name or pseudonym on the work, and to have a real name or pen name mentioned on the work. name when the work is published or used; Copying, adapting or transmitting or disseminating a work to the public by allowing others to participate in the process of exploiting the work.
Pursuant to Article 25 Decree 22/2018/ND-CP There are regulations on copyright and related rights of copyright owners as follows:
“Copyright owners specified in Article 36 of the Intellectual Property Law include:
1. Vietnamese organizations and individuals.
2. Foreign organizations and individuals whose works are created and expressed in certain material forms in Vietnam.
3. Foreign organizations and individuals whose works are published for the first time in Vietnam.
4. Foreign organizations and individuals whose works are protected in Vietnam according to international treaties to which the Socialist Republic of Vietnam is a member.
So, copyright owners include:
- Vietnamese organizations and individuals.
- Foreign organizations and individuals whose works are created and expressed in certain material forms in Vietnam;
- Foreign organizations and individuals whose works are published for the first time in Vietnam;
- Foreign organizations and individuals whose works are protected in Vietnam according to international treaties to which Vietnam is a member.
