This article explains the important role of the principles of consumer protection under the Law on Consumer Protection 2023. Understanding the role of these principles helps you grasp how the law protects consumers' rights, thereby ensuring your rights and responsibilities in the consumption process. The article also provides insight into how these principles maintain fairness and safety for consumers in the modern legal context.
The current state of consumer protection in Vietnam shows that violations of consumer rights are increasing in both quantity and severity. Methods and tricks of production and trading of prohibited goods, smuggled goods, counterfeit goods, poor quality goods, and goods of unknown origin are also becoming more and more complex and sophisticated.
In addition, with the emergence of e-commerce, which is characterized by the method of concluding contracts online, the rights of consumers are also somewhat affected. Because when establishing a contract remotely, consumers often do not have direct contact and check the quality of the product (until they have agreed to enter into a contract), do not participate in the process of drafting contract templates and terms of contract, but are completely unilaterally and proactively drafted and applied by the enterprise.
Therefore, the problem of consumer rights violations from contracts that do not comply with legal regulations is also increasing in both quantity and complexity... To limit this problem, mastering the principles of consumer rights protection is an effective method, as a guideline to create an important legal corridor in protecting consumer rights.
In addition, protecting consumer rights also contributes to promoting the building of a healthy business environment for enterprises and individuals, creating an important driving force for the stable development of the economy. This is also the spirit expressed by the Minister of Industry and Trade at the working session with the General Department of Market Management and 63 Departments of Industry and Trade, Steering Committee 389 nationwide on the situation of goods supply with "the ultimate goal must be to create a healthy business environment, create motivation for enterprises to produce and trade, protect the rights and interests of consumers".
