According to Article 9 of the Law on Protection of Consumer Rights 2023, the protection of consumer rights in transactions with individuals conducting independent, regular commercial activities without business registration is regulated as follows:
1. Individuals who operate independent and regular commercial activities and are not required to register their business under the provisions of this Law must only carry out the following responsibilities:
a) Ensuring safety, measurement, quantity, volume, quality, and use of products, goods, and services that they sell and provide to consumers;
b) Do not sell or provide consumers with products, goods or services that are illegal, contrary to good customs and social ethics;
c) Provide accurate and complete information about the products, goods and services that you sell and provide to consumers;
d) Exchange goods for consumers or return money and receive goods back from consumers in cases where the goods sold or provided by us do not ensure safety, measurement, quantity, volume, or quality. , uses the same as the information I provide;
d) Comply with the decision to recall products and goods in case the products and goods sold or supplied by you are subject to recall; bear the costs of destroying products and goods in case the products and goods must be destroyed according to the decision of a competent authority;
e) Other responsibilities according to Government regulations.
2. Based on the provisions of this Law and other relevant laws, the Government details the protection of consumer rights in transactions with individuals conducting independent and regular commercial activities. , does not require business registration.
3. Based on the provisions of this Law, the Government's regulations and specific local conditions, the Commune People's Committee, the management board of markets and commercial areas shall implement specific measures to ensure safety, measurement, quantity, volume, quality of products, goods, services and protect other legitimate rights and interests of consumers when purchasing and using products, goods, Services of individuals conducting independent, regular commercial activities, without business registration.
