Registering an international trademark under the Madrid System is a crucial step to protect your brand in the global market. To achieve this, trademarks originating from Vietnam must meet certain conditions and follow a specific application procedure. This article provides a detailed guide on the necessary conditions and filing procedure for international trademark registration, helping you effectively expand your brand protection scope.
1. Conditions and procedures for filing an international registration application for a trademark of Vietnamese origin under the Madrid System are as follows:
- Individuals with nationality in a country that is a member of the Madrid System or an organization with a legal business establishment in a country that is a member of the Madrid System have the right to apply for international trademark registration under the Madrid System.
- The international trademark registration application under the Madrid System needs to be based on the basic registration application that has been submitted to the National Office of Intellectual Property or has been granted a Trademark Registration Certificate by the National Office of Intellectual Property.
- Documents for international registration of trademarks originating in Vietnam include:
(i) 02 declarations requesting international registration of trademarks of Vietnamese origin, typed according to form number: 06-DKQT Appendix C of Circular No. 01/2007/TT-BKHCN;
(ii) 02 copies of MM2 Declaration [posted on website: http://wipo.int (language used is English)];
(iii) 05 attached trademark samples (In case of registration as a color trademark, in addition to 05 color trademark samples, the applicant needs to submit 05 black and white trademark samples);
(iv) Power of Attorney (if the international trademark registration application of Vietnamese origin is filed through industrial property representation service organizations);
(v) A photocopy of the establishment registration application or a photocopy of the Trademark Registration Certificate;
(vi) 02 copies of MM18 in case of international trademark registration application with indication to the United States;
(vii) Preliminary appraisal fee paid to the National Office of Intellectual Property: 2,000,000 VND;
(viii) Fees paid to the International Office are posted on the website: http://wipo.int
2. Application form
The applicant can submit an application for international registration of a trademark of Vietnamese origin directly or via postal service to one of the application receiving points of the National Office of Intellectual Property, specifically:
- Head office of the Department of Intellectual Property, address: 386 Nguyen Trai, Thanh Xuan district, Hanoi city.
- Representative office of the National Office of Intellectual Property in Ho Chi Minh City, address: 7th Floor, Ha Phan Building, 17/19 Ton That Tung, Pham Ngu Lao Ward, District 1, Ho Chi Minh City.
- Representative office of the Department of Intellectual Property in Da Nang city, address: 3rd floor, 135 Minh Mang, Khue My ward, Ngu Hanh Son district, Da Nang city.
In case of submitting the application by post, the applicant needs to transfer money through the post office service, then photocopy the Money Transfer Receipt and send it along with the application to one of the Department's above-mentioned application receiving points. Intellectual property to prove the amount paid.
(Note: When transferring fees and charges to one of the above application receiving points of the National Office of Intellectual Property, the applicant needs to send the dossier via corresponding post office to that application receiving point).
