Conditions for granting a license for hazardous waste treatment
Discover the requirements for obtaining a Hazardous Waste Treatment License, ensuring compliance with the law and environmental safety.
1. Regulations on collection and transportation of hazardous waste
According to Article 8 of Decree 08/2022/ND-CP, regulations on the collection and transportation of hazardous waste are as follows:
1. The collection and transportation of hazardous waste is only permitted by organizations and individuals with a Hazardous Waste Treatment License.
2. Vehicles and equipment for collecting and transporting hazardous waste must meet technical requirements and management procedures as prescribed. Vehicles transporting hazardous waste must be recorded in the Hazardous Waste Treatment License.
3. The use of special means of transport such as containers, railway vehicles, inland waterways, sea routes or means of transport not listed in the Hazardous Waste Treatment License must meet the technical requirements and management procedures as prescribed by the Ministry of Natural Resources and Environment and be approved by the Ministry of Natural Resources and Environment.
4. Transportation of hazardous waste must follow an optimal route in terms of route, distance, time, ensuring traffic safety and preventing and responding to incidents, in accordance with regulations of competent authorities on traffic flow.
2. Regulations on conditions for being granted a license to handle hazardous waste
According to Article 9 of Decree 08/2022/ND-CP, the conditions for being granted a License for hazardous waste treatment are as follows:
1. Have an environmental impact assessment report approved by the Ministry of Natural Resources and Environment.
a) Valid environmental documents issued by competent state management agencies for hazardous waste treatment facilities put into operation before July 1, 2006, including: Certificate of registration of meeting environmental standards; document assessing the declaration of production and business activities that impact the environment; environmental impact assessment appraisal form; or documents equivalent to these documents;
b) Environmental protection plan approved by competent state management agency according to regulations for hazardous waste treatment facilities put into operation.
2. The location of the hazardous waste treatment facility (except for production facilities that co-treat hazardous waste) is included in the planning with contents on waste management and treatment approved by competent authorities at provincial level or higher in accordance with the provisions of law.
3. Processing systems and equipment (including pre-processing, recycling, co-processing, energy recovery), packaging, storage equipment, temporary or transit storage areas, and means of transport (if any) must meet technical requirements and management procedures as prescribed.
4. There are environmental protection works at hazardous waste treatment facilities that meet technical requirements and management processes as prescribed.
5. Have a team of staff meeting the following requirements:
a) A hazardous waste transfer station must have at least 01 (one) person in charge of management, operation, and professional and technical guidance with professional qualifications in a field related to the environment or chemistry;
b) Have a team of operators and drivers trained to ensure safe operation of vehicles, systems and equipment.
6. Have a safe operating procedure for vehicles, systems, and equipment for collecting, transporting (if any) and treating (including pre-processing, recycling, co-processing, and energy recovery) hazardous waste.
7. Have an environmental protection plan that includes the following contents: Pollution control and environmental protection plan; occupational safety and health protection plan; incident prevention and response plan; periodic training and coaching plan; environmental monitoring program, monitoring of treatment operations and evaluating the effectiveness of hazardous waste treatment.
8. Have a plan for pollution control and environmental restoration upon termination of operations.
