Base Article 11 Law on Complaints 2011 Regulations on cases where complaints are not resolved by the prosecutor are as follows:
"Article 11. Complaints are not accepted for settlement
Complaints in one of the following cases will not be accepted for resolution:
1. Administrative decisions and administrative acts within state agencies to direct and organize the performance of tasks and public duties; administrative decisions and administrative acts in the direction of administration between superior administrative agencies and lower-level administrative agencies; Administrative decisions containing legal regulations issued by competent agencies, organizations, and individuals according to the order and procedures of the law on promulgation of legal documents; administrative decisions and administrative acts within the scope of state secrets in the fields of defense, security and diplomacy according to the list prescribed by the Government;
2. The administrative decision or administrative act complained of is not directly related to the legitimate rights and interests of the complainant;
3. The complainant does not have full civil act capacity without a legal representative;
4. The complaint is not legally made by the representative;
5. The complaint does not contain the signature or fingerprint of the complainant;
6. The statute of limitations or time limit for complaints has expired without a legitimate reason;
7. The complaint has had a decision to resolve the second complaint;
8. There is a written notice to stop the resolution of the complaint but after 30 days the complainant does not continue to complain;
9. The complaint has been accepted by the Court or has been resolved by the Court's judgment or decision, except for the Court's decision to suspend the resolution of the administrative case."
Accordingly, in cases where parents file a complaint on behalf of their child but do not have a letter of authorization or the petition does not have the complainant's signature or fingerprint, in this case the Commune People's Committee will not comply. The settlement is in accordance with the law.
