Change of company headquarters address in a partnership company

Changing the address of a partnership company's headquarters must comply with current legal regulations. This article will provide detailed instructions on the steps to take, from preparing documents to submitting a notice of change of address to the competent authority, helping businesses follow the correct procedures and avoid legal risks.

1. General provisions

A partnership must register a change of the partnership's head office address within 10 days from the date of change.

Before registering to change the head office address to a district, province, or centrally-run city other than the head office, resulting in a change in the managing tax authority, the partnership must carry out procedures with the tax authority related to the change of location according to the provisions of tax law - see details in the work "Change of tax registration information".

2. Profile components:

2.1. Notice of change in business registration content signed by the legal representative of the partnership (form Appendix II-1 issued with Circular 01/2021/TT-BKHĐT);

2.2. Resolution and Decision of the Board of Members on changing the head office address of the partnership;

2.3. Valid copy of the Minutes of the meeting of the Board of Members on the change of the head office address of the partnership;

2.4. Authorization letter for the person submitting the application and receiving the results if he/she is not the legal representative. This document does not need to be notarized or authenticated;

2.5. A valid copy of one of the following personal identification documents of the authorized person to carry out the procedure (if authorized):

- For Vietnamese citizens: Valid Citizen Identification Card or National Identity Card or Vietnamese Passport.

- For foreigners: Valid foreign passport or document in lieu of a valid foreign passport.

Place to submit documents: Business Registration Office - Department of Planning and Investment where the partnership has registered (In case of changing the head office address of the partnership to another province or centrally-run city where the partnership has registered, send the documents to the Business Registration Office where the new head office is planned to be located).

3. Processing time: Within 03 (three) working days from receipt of valid documents.
