This article will answer the question of whether foreigners can buy houses in Vietnam. Pursuant to Clause 3, Article 7 of the 2014 Housing Law, it is stipulated as follows:
“Article 7. Subjects eligible to own houses in Vietnam
1. Domestic organizations, households and individuals.
2. Vietnamese people living abroad.
3. Foreign organizations and individuals specified in Clause 1, Article 159 of this Law”
Pursuant to Point c Clause 1, Point b Clause 2 Article 159 of the 2014 Housing Law, it is stipulated as follows:
Article 159. Subjects eligible to own houses and forms of house ownership in Vietnam by foreign organizations and individuals
1. Foreign organizations and individuals who are allowed to own houses in Vietnam include:
a) Foreign organizations and individuals investing in housing construction projects in Vietnam according to the provisions of this Law and relevant laws;
b) Foreign-invested enterprises, branches, representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam (hereinafter referred to as foreign organizations);
c) Foreign individuals are allowed to enter Vietnam.
2. Foreign organizations and individuals are allowed to own houses in Vietnam through the following forms:
a) Investing in housing construction projects in Vietnam according to the provisions of this Law and relevant laws;
b) Purchase, hire-purchase, receive as a gift, or inherit commercial housing including apartments and individual houses in housing construction investment projects, except for areas ensuring national defense and security as prescribed by the Government.
Accordingly, foreigners are allowed to buy houses in Vietnam, including apartments and individual houses in housing construction investment projects, except for areas ensuring national defense and security according to Government regulations.
