According to Article 37 of the Law on Consumer Protection 2023, the responsibilities of business organizations and individuals in remote transactions are stipulated as follows:
1. When conducting remote transactions, business organizations and individuals must accurately and completely provide consumers with the following information:
a) Name, address, telephone number, other contact methods (if any) of the business organization or individual or of the representative of the business organization or individual in Vietnam (if any);
b) Business registration certificate number or business code or other equivalent document for economic organizations; personal tax code for individuals;
c) Measurement, quantity, volume, quality, uses, price, origin, provenance, and shelf life of products, goods, and services;
d) Delivery costs (if any);
d) Payment method and term; time, place and method of selling and providing products, goods and services; conditions and methods of exchanging and returning products, goods and services;
e) Effective period of the transaction proposal;
g) Information on fees, costs, value added tax, fee calculation methods, costs that may arise and general transaction conditions applicable in the process of providing products, goods and services to consumers;
h) Details on the uses, usage, and warranty of products, goods, and services;
i) Consumer rights as prescribed in Clause 3, Article 38 of this Law;
k) Procedures for handling the exchange, return of products, goods, services or termination of signed contracts;
l) Procedure for receiving and resolving consumer feedback, requests and complaints.
2. In case the transaction is conducted via telephone or other form of communication or conversation, the business organization or individual is responsible for informing from the beginning about his/her name, address and purpose of the conversation.
3. In case transactions are conducted in cyberspace, business organizations and individuals are responsible for implementing the provisions of this Law, the law on e-commerce and other relevant legal provisions.
4. The Government shall detail this Article.
