Pursuant to Article 97 of the 2015 Civil Procedure Code, the provisions on verification and collection of evidence are as follows:
Verify, collect evidence
1. Agencies, organizations and individuals have the right to collect documents and evidence by themselves using the following measures:
a) Collect readable, audible, visible documents; electronic data messages;
b) Collect evidence;
c) Identify witnesses and obtain witness confirmation;
d) Request agencies, organizations and individuals to copy or provide documents related to the settlement of the case that the agency, organization or individual is keeping or managing;
d) Request the People's Committee at the commune level to certify the witness's signature;
e) Request the Court to collect documents and evidence if the parties are unable to collect documents and evidence;
g) Request the Court to issue a decision requesting an appraisal and valuation of assets;
h) Requesting agencies, organizations and individuals to perform other tasks as prescribed by law.
Thus, enterprises providing goods and services have the right to collect documents and evidence themselves to prove that they are not at fault by the following measures:
- Collect readable, audible, visible documents; electronic data messages;
- Collect evidence;
- Identify witnesses and obtain witness confirmation;
- Requesting agencies, organizations and individuals to copy or provide documents related to the settlement of the case that the agency, organization or individual is keeping or managing;
- Request the People's Committee at the commune level to certify the witness's signature;
- Request the Court to collect documents and evidence if the parties cannot collect documents and evidence;
- Request the Court to issue a decision requesting appraisal and valuation of assets;
-Request agencies, organizations and individuals to perform other tasks as prescribed by law.
