Pursuant to Clause 5, Article 94 Construction Law 2014 Amended by Clause 33, Article 1 Amended Construction Law 2020 There are regulations Conditions for granting construction permits are limited as follows:
“5. For construction projects and individual houses that fall into the cases specified in Point a, Clause 1 of this Article and have district-level annual land use plans, no time-limited construction permit will be issued for the construction. New construction but only a limited construction permit is issued for repair and renovation.
In case after 03 years from the date of announcement of the district's annual land use plan, the competent state agency has not yet made a decision to recover land or not allowed to change the land use purpose according to the use plan. The district's annual land use plan has been announced without adjustment or cancellation, or if it has been adjusted or canceled but the adjustment or cancellation of the district's annual land use plan has not been announced, the land user may The right to request a construction permit for a limited period of time according to the provisions of Clauses 2 and 3 of this Article.
Thus, areas that have annual land use plans are not granted a construction permit with a term for new construction, but only a construction permit with a term for repair and renovation.
However, land users have the right to apply for a construction permit with a limited term in the case that after 03 years from the date of announcement of the district's annual land use plan:
- The competent state agency has not yet made a decision to recover land
- Competent state agencies have not given permission change land use purpose according to the district-level annual land use plan that has been announced without adjustment or cancellation or with adjustment or cancellation but no adjustment or cancellation of the district-level annual land use plan has been announced.
