This article provides detailed information about the possibility for a complainant abroad to authorize someone else to file a complaint in Vietnam. It includes legal regulations, procedures, and necessary conditions for authorization, ensuring the complainant's rights are legally protected.
Base Article 12 Law on Complaints 2011 Regulations on the rights and obligations of complainants are as follows:
"Article 12. Rights and obligations of the complainant
1. The complainant has the following rights:
a) Complain yourself.
In case the complainant is a minor or a person who has lost civil act capacity, their legal representative shall make the complaint;
In case the complainant is sick, old, weak, has physical weaknesses or for other objective reasons cannot make the complaint himself/herself, he/she can authorize his/her father, mother, wife, husband, brother, sister or younger sibling. , adult child or other person with full civil capacity to make a complaint.
Thus, if an individual cannot personally authorize the case for the objective reason of being exported to work, it is necessary to make an authorization contract for parents in Vietnam to make a complaint on their behalf.
This authorization contract must be notarized at the Embassy/Consulate of Vietnam in the country where the authorizer resides. Then send the original notarized authorization contract to Vietnam and have the contract notarized at a notary office in Vietnam to complete the authorization contract notarization procedure.
