This article explains in detail about the authority and process of carrying out marriage registration procedures with foreigners in Vietnam. Learn who has the authority to resolve and the steps to ensure that the registration process is conducted in accordance with the law and smoothly.
According to Article 37 of the 2014 Law on Civil Status, the authority to carry out marriage registration between Vietnamese citizens and foreigners belongs to the People's Committee at the district level where the Vietnamese citizen resides.
If a foreigner residing in Vietnam requests to register for marriage in Vietnam, then the People's Committee at the district level where one of the parties resides will carry out the marriage registration.
Marriage registration procedures with foreigners in Vietnam
Step 1: Submit marriage registration documents
According to Article 37 of the 2014 Law on Civil Status, The People's Committee (PC) of the district is authorized to carry out marriage registration procedures with foreigners.
Therefore, after preparing complete documents, both parties or one of the two persons will submit directly to the PC at the district level where they reside or submit online through the National Public Service Portal.
After submitting the documents, the competent authority will verify the information and compare the original documents. If the documents are complete and valid, a receipt will be issued, which will contain information on the time to receive the result.

Step 2: Department of Justice reviews the documents
The Department of Justice conducts research, review, verification, and settlement of marriage registration documents. The head of the Department of Justice is responsible for the review results and proposals of the Department of Justice in handling the marriage registration documents.
When the valid documents have been verified and both parties meet the conditions for marriage according to the provisions of the 2014 Law on Marriage and Family, not falling into the category of refusing to register for marriage then the Department of Justice reports to the President of the district-level People's Committee to sign 02 original Marriage Certificate.
Step 3: Return the Marriage Certificate
After signing the Marriage Certificate registration, the civil registration officer will guide both parties to check the contents of the Marriage Certificate and the Marriage Registration Book.
The period from receiving complete documents to receiving the Marriage Certificate is a maximum of 13 working days.
Deadline for receiving the Marriage Registration Certificate: Within not more than 60 days from the date of registration, both parties need to go to the district-level People's Committee to receive the Marriage Certificate. If they fail to receive the marriage certificate within the specified period, the marriage registration will be canceled. If both parties still want to get married, they must go through this procedure again.
* Marriage registration fee for foreigners
- Hanoi: Resolution 20/2016/NQ-HDND amended and supplemented by Resolution 09/2018/NQ-HDND by the People's Council of Hanoi stipulates the fee for marriage registration at the district level to be 1 million VND/ registration.
- Ho Chi Minh City: The registration fee for marriage registration falls under the jurisdiction of the district-level People's Committee, which is 1 million VND/ case according to Resolution 124/2016/NQ-HDND issued by the People's Council of Ho Chi Minh City.
