Administrative fines for violating regulations on discharging wastewater into the environment

Discharging wastewater into the environment without proper regulations can cause serious consequences for the ecosystem and human health. To prevent and handle violations, Vietnamese law has clearly stipulated administrative penalties for cases of illegal wastewater discharge. This article will provide detailed information on current penalties, aiming to raise awareness and encourage compliance with the law in environmental protection.

Pursuant to the Law on Environment 2020; Decree 155/2016/ND-CP, supplemented and amended by Decree 55/2021/ND-CP Article 13 of Decree 155/2016/ND-CP, amended and supplemented by Decree 55/2021/ND-CP, regulates the discharge of wastewater with normal environmental parameters into the environment as follows:

1. Warning penalty for discharging wastewater exceeding technical standards on waste by less than 1.1 times

Warning penalty for the act of discharging wastewater exceeding technical standards on waste by less than 1.1 times (equivalent to exceeding technical standards by 10%).

2. Act of discharging wastewater exceeding technical standards on waste from 1.1 times to less than 1.5 times

The act of discharging wastewater exceeding technical standards on waste from 1.1 times to less than 1.5 times or discharging wastewater exceeding technical standards on waste less than 1.1 times in case of recidivism or multiple violations will be punished as follows:

a) A fine of 300,000 VND to 500,000 VND in case of discharging wastewater of less than 05 m³/day (24 hours);

b) A fine of VND 500,000 to VND 2,000,000 in case of discharging wastewater from 05 m³/day (24 hours) to less than 10 m³/day (24 hours);

c) A fine of from VND 2,000,000 to VND 5,000,000 in case of discharging wastewater from 10 m³/day (24 hours) to less than 20 m³/day (24 hours);

d) A fine of from VND 5,000,000 to VND 10,000,000 in case of discharging wastewater from 20 m³/day (24 hours) to less than 40 m³/day (24 hours);

d) A fine of from VND 10,000,000 to VND 20,000,000 in case of discharging wastewater from 40 m³/day (24 hours) to less than 60 m³/day (24 hours);

e) A fine of from VND 20,000,000 to VND 40,000,000 in case of discharging wastewater from 60 m³/day (24 hours) to less than 80 m³/day (24 hours);

g) A fine of from VND 40,000,000 to VND 50,000,000 in case of discharging wastewater from 80 m³/day (24 hours) to less than 100 m³/day (24 hours);

h) A fine of from VND 50,000,000 to VND 60,000,000 in case of discharging wastewater from 100 m³/day (24 hours) to less than 200 m³/day (24 hours);

i) A fine of from VND 60,000,000 to VND 70,000,000 in case of discharging wastewater from 200 m³/day (24 hours) to less than 400 m³/day (24 hours);

k) A fine of from VND 70,000,000 to VND 80,000,000 in case of discharging wastewater from 400 m³/day (24 hours) to less than 600 m³/day (24 hours);

l) A fine of from VND 80,000,000 to VND 90,000,000 in case of discharging wastewater from 600 m³/day (24 hours) to less than 800 m³/day (24 hours);

m) A fine of from VND 90,000,000 to VND 100,000,000 in case of discharging wastewater from 800 m³/day (24 hours) to less than 1,000 m³/day (24 hours);

n) A fine of from VND 100,000,000 to VND 110,000,000 in case of discharging wastewater from 1,000 m³/day (24 hours) to less than 1,200 m³/day (24 hours);

o) A fine of from VND 110,000,000 to VND 120,000,000 in case of discharging wastewater from 1,200 m³/day (24 hours) to less than 1,400 m³/day (24 hours);

p) A fine of from VND 120,000,000 to VND 130,000,000 in case of discharging wastewater from 1,400 m³/day (24 hours) to less than 1,600 m³/day (24 hours);

q) A fine of from VND 130,000,000 to VND 140,000,000 in case of discharging wastewater from 1,600 m³/day (24 hours) to less than 1,800 m³/day (24 hours);

r) A fine of from VND 140,000,000 to VND 150,000,000 in case of discharging wastewater from 1,800 m³/day (24 hours) to less than 2,000 m³/day (24 hours);

s) A fine of from VND 150,000,000 to VND 170,000,000 in case of discharging wastewater from 2,000 m³/day (24 hours) to less than 2,500 m³/day (24 hours);

t) A fine of from VND 170,000,000 to VND 190,000,000 in case of discharging wastewater from 2,500 m³/day (24 hours) to less than 3,000 m³/day (24 hours);

u) A fine of from VND 190,000,000 to VND 210,000,000 in case of discharging wastewater from 3,000 m³/day (24 hours) to less than 3,500 m³/day (24 hours);

ư) A fine from VND 210,000,000 to VND 230,000,000 in case of discharging wastewater from 3,500 m³/day (24 hours) to less than 4,000 m³/day (24 hours);

v) A fine from VND 230,000,000 to VND 250,000,000 in case of discharging wastewater from 4,000 m³/day (24 hours) to less than 4,500 m³/day (24 hours);

x) A fine from VND 250,000,000 to VND 270,000,000 in case of discharging wastewater from 4,500 m³/day (24 hours) to less than 5,000 m³/day (24 hours);

y) A fine from VND 270,000,000 to VND 300,000,000 in case of discharging wastewater of 5,000 m³/day (24 hours) or more.
